Kroy “KJ” Biermann Jr, the 15-year-old son of former Atlanta Falcons player Kroy Biermann and reality television personality Kim Zolciak, has been indicted on seven charges following allegations of sexual assault in Alpharetta, Georgia.
The indictment reportedly includes aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment and three counts of sexual battery against a child under 16.
Biermann Jr was initially arrested on August 17 and charged with aggravated sodomy and aggravated sexual battery. Alpharetta police confirmed that he was being prosecuted as an adult, despite his age.
Alleged incident at Life Time Fitness
The case relates to an incident reported on April 23 at a Life Time Fitness facility on North Point Parkway, according to police records and arrest warrants filed in Fulton County.
Investigators allege that Biermann Jr met a 15-year-old acquaintance at the gym’s café before taking her to a family changing area. The girl told police that he restrained her, made unwanted sexual contact and forced her to take part in sexual acts against her will.
She was later examined by a Sexual Assault Nurse Examiner at Children’s Healthcare of Atlanta and underwent a forensic examination. The arrest warrant states that testing did not identify male DNA on the alleged victim.
Police also sought security footage and other digital evidence as part of their investigation, according to court documents reported by TMZ.
Kim Zolciak denies allegations
Zolciak has strongly denied the claims on her son’s behalf. In a statement to TMZ, she said: “The allegations being made against my son are nothing short of reckless and deeply troubling. He categorically denies ever being involved with this woman or engaging in the conduct she has alleged.”
She also said Biermann Jr had voluntarily taken and passed a polygraph examination. The teenager and his legal team have not publicly addressed the indictment in detail.
Biermann Jr’s lawyers filed a request on September 2 seeking his release on bond. The application argues that he is not a flight risk and points to his academic record, athletic achievements and ties to his parents, siblings, teachers and coaches.
He has remained in custody without bond while the case proceeds. His lawyers have also asked for the proceedings to remain confidential, noting that both the defendant and the alleged victim are minors.
The allegations have not been tested at trial. Biermann Jr is presumed innocent unless and until he is proved guilty.
