Lachie Neale’s tribunal appeal has taken a new turn after the AFL sought to introduce previously unseen footage of the incident at the centre of the case.
AFL counsel Andrew Woods KC told the appeal board the vision came from an optical tracking trial, which involved additional cameras at the MCG on Saturday. The AFL became aware of the footage on Wednesday afternoon and shared it with the Brisbane Lions immediately.
The board must now decide whether the material can be admitted as new evidence. It can allow such evidence only if it could not have been obtained before the original hearing.
Neale’s counsel, Adrian Anderson, is making submissions on whether the vision should be shown and has expressed clear reservations about its admission.
The footage is reportedly likely to make it difficult for Neale’s legal team to challenge the finding that the contact with Jack Ginnivan was intentional.
The appeal board is chaired by Richard Loveridge, with Stephen Jurica and Wayne Henwood also sitting on the panel.
