Lindsay Clancy’s lawyer has asked a Massachusetts judge to investigate the juror who held out during deliberations in her trial, seeking access to his phone records and information about a 2021 criminal charge.
Kevin Reddington has requested the confidential juror questionnaire and “Juror Doe’s record from the statewide domestic violence registry”. He is also seeking the juror’s calls, text messages and mobile data from 27 August to 4 September.
Those dates cover the period when the jury was considering whether Clancy should be found guilty of murdering her three children.
Reddington has also asked the court to preserve all jury notes, together with the judge’s responses to them. His filing seeks a thorough examination of the conduct and background of the juror, who was identified at trial as Juror 10.
The juror has publicly identified himself as 48-year-old Michael Péguy Desronvil. He has said the prosecution convinced him of Clancy’s guilt, while the other 11 jurors believed there was sufficient reasonable doubt to support a not guilty by reason of insanity verdict.
In the aftermath of the mistrial, Reddington criticised the holdout juror without naming him and claimed he had disregarded the judge’s instructions.
Massachusetts prosecutors have not announced whether they intend to retry Clancy.
