Harvey Weinstein is due to be sentenced in Manhattan on Wednesday for the 2006 sexual assault of former television production assistant Miriam Haley, more than six years after his original New York conviction was overturned.
Weinstein, 74, was convicted last year of first-degree criminal sexual act after Haley told jurors that he forcibly performed oral sex on her at his Manhattan apartment. He faces up to 25 years in prison, while Manhattan prosecutors are seeking a 20-year sentence. Haley, who has also used the name Mimi Haleyi, is expected to address the court with a victim impact statement. Her lawyer, Gloria Allred, said she planned to speak at the hearing, while Weinstein’s spokesperson said the former film producer would also address the judge.
The sentencing follows a lengthy legal battle that began with Weinstein’s 2020 conviction for assaulting Haley and raping aspiring actress Jessica Mann. He was then sentenced to 23 years in prison.
New York’s highest court overturned those convictions in April 2024, ruling that Weinstein had been prejudiced by testimony about allegations that were not part of the charges against him.
At a retrial in 2025, jurors convicted him over the assault on Haley but acquitted him of a separate sexual assault allegation involving Kaja Sokola. They were unable to reach a verdict on the rape charge involving Mann.
Prosecutors later abandoned that charge rather than pursue a fourth trial after Mann said she could no longer endure giving evidence again. Weinstein denies raping or sexually assaulting anyone and is expected to appeal if sentenced. His lawyers have not publicly stated what penalty they will seek.
He is also awaiting resentencing in California, where his 2022 rape and sexual assault conviction was upheld but an appeals court set aside his 16-year prison term and ordered a new sentencing hearing. Weinstein remains in custody at a medical unit for jail inmates at Bellevue Hospital in Manhattan. His lawyers have cited chronic myeloid leukaemia, diabetes and difficulty walking, with a wheelchair required for court appearances.

Haley, 49, was born in Finland and raised in Sweden. She met Weinstein through a professional connection and briefly worked as a production assistant on the reality television programme Project Runway, which he produced.
She testified that she accepted an invitation to visit Weinstein’s apartment before travelling to Los Angeles for a film premiere. After initially speaking with him in the living room, she said he lunged to kiss her, grabbed her and forced her into a bedroom despite her pleas to stop.
Haley also described a later encounter involving unwanted sex and said she warned Weinstein: “You know you can’t keep doing this.”
The Manhattan hearing marks the latest stage in a case that helped drive the #MeToo movement and has kept Weinstein behind bars through convictions, appeals and repeated retrials.
