Federal prosecutors in Texas have charged a Venezuelan delivery driver who was shot by an Immigration and Customs Enforcement agent with assaulting a federal officer.
Wilber Rafael Garces Perez, 28, is accused of striking an ICE officer with his vehicle while driving away in an attempt to evade arrest, according to court documents made public on Tuesday.
The Venezuelan national was shot by the ICE agent earlier this month. The charge relates to the alleged vehicle impact, and the documents do not establish that he has been convicted of the offence.
The Department of Homeland Security has said Mr Garces Perez was living illegally in the United States after an immigration judge ordered his deportation.
