A text exchange from a Cornell University disciplinary hearing is being cited by at least one man accused of rape as evidence that Jane Doe was not incapacitated during a 2024 party at the Chi Phi fraternity.
The issue of Doe’s state of inebriation could be central to whether she was able to consent to sex. She says one of the men was snorting ketamine off her body and that she was too impaired to process what was happening.
The exchange took place between 30 minutes and an hour after the alleged incident, according to the material from the hearing. At 3.05am, one of Doe’s roommates asked: “You coming home tn (tonight)?”
Doe replied: “idk” – short for “I don’t know”. One of the accused men claims the response shows she could read, process and answer the message, and therefore was not incapacitated.
Doe’s roommate has said she appeared to be in a fog after the party and only began recalling what had happened over the following days and weeks.
At 11.15am the next morning, the roommate posted a photograph with the caption: “It was a good night when only one out three of us made it back.”
Doe’s lawyer has been contacted for a response but had not replied.
