A bystander was shot in the torso and leg after a gunman opened fire outside a restaurant in south-west Houston following an argument with staff, police said.
The shooting happened shortly before 11.30pm on Saturday near the junction of Beechnut Street and Corporate Drive, according to the Houston Police Department.
Officers said a man in his 50s and his nephew had become intoxicated inside the restaurant and were asked to leave by security staff and the owner.
After leaving, the suspect went to his vehicle, retrieved a handgun and fired towards the business, police said.
A man in his 30s, who was standing outside with another witness, was caught in the gunfire. Investigators believe he was not the intended target and was struck at random.
He was taken to hospital with gunshot wounds to his torso and leg and remained alive and receiving treatment.
No arrest had been made. Police said they had identified the suspect and were following leads with the help of witnesses who were at the scene.
