Kroy Biermann Jr, the 15-year-old son of reality television star Kim Zolciak and former NFL player Kroy Biermann, has been indicted on seven felony charges in Georgia after a female classmate accused him of sexual assault.
A Fulton County grand jury returned the indictment on Thursday, September 3, in connection with an alleged incident at a Life Time Fitness centre in Alpharetta on April 23.
Biermann Jr faces charges of aggravated child molestation, aggravated sodomy, aggravated sexual battery, three counts of aggravated sexual battery against a child under 16 and false imprisonment.
Police allege that the teenager led the girl into a family changing area after meeting her at the gym. The girl told investigators that he touched her despite her saying no, forced her to perform a sex act and tried repeatedly to pull down her trousers.
The teenager was arrested on August 17 and remains in custody at the Metro Regional Youth Detention Centre in Atlanta. A court hearing is scheduled for next week.
His legal team filed a petition for bond on Wednesday, arguing that he was not a flight risk and pointing to his academic record, athletic achievements and strong ties to his family and local community.
The lawyers said he had continued attending school and sporting activities after learning of the allegations in April. They also said he had voluntarily taken a polygraph examination and had not left Georgia.
His representatives have asked for the case to be kept confidential because both Biermann Jr and the alleged victim are juveniles, while noting the intense public interest generated by his mother’s profile.
Zolciak, who appeared on The Real Housewives of Atlanta, has strongly denied the allegations against her son.
In a statement issued after his arrest, she described the claims as “reckless and deeply troubling” and said: “He categorically denies ever being involved with this woman or engaging in the conduct she has alleged.”
She added that her son had passed a voluntary polygraph examination and that an examination had found no DNA belonging to him. “We remain confident that the facts and evidence will establish the truth,” she said.
Attorney Jason Sheffield has also insisted that Biermann Jr is innocent, saying his client had tried to provide investigators with evidence, including the polygraph result.
Medical examinations carried out after the alleged assault reportedly found no male DNA on or inside the areas examined. The absence of DNA does not determine the outcome of the criminal proceedings, which remain ongoing.
